These Terms and Conditions ("the Terms and Conditions") govern your ("the User") use of The Scuba Pro Store ("Provider") website located at the domain name www.thescubaprostore.co.za ("the Website"). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute content obtained on the website for marketing and other purposes without the consent of the Provider.

Should you place an order with us, you are making an offer to purchase and your offer is considered accepted when we dispatch the goods from our warehouse. We reserve the right to reject or cancel any offer at our discrection prior to acceptance and if payment is received, cancelled orders will be refunded in full.

Detailed Description of Goods and / or Services

Scuba Equipment Africa (T/A The Scuba Pro Store) is a business in the Southern African Dive industry that sells Diving Equipment and Diving Related Products online.

Delivery policy

Orders are processed Monday to Friday, excluding public holidays. Orders are not delivered on the weekends or public holidays.

We suggest that you request shipping your order to a business address. We do not ship to postal addresses or multiple addresses per order.

If a product is in stock and is not a special order item, we’ll dispatch your order within 1 working day provided there are no problems with authorising your payment and you placed your order before 12h00.

If a product is not in stock in our warehouse, or is a special order item, then we are unable to confirm an expected delivery time or date and this will be provided only after the transaction.

Return and Refunds Policy

All items purchased from The Scuba Pro Store may be cancelled, exchanged or returned provided these items are returned unused, in original packaging and in pristine condition within the stipulated time period.

You are entitled to cancel without reason and without penalty any transaction of goods purchased from The Scuba Pro Store within seven (7) working days after the date of the receipt of the goods.

Credit card payments will be refunded to the card used to make the purchase and purchases made by direct transfer will be refunded to the account of origin. Refunds will be made within thirty (30) days of the date of receipt of cancellation. Costs and arrangement for returning cancelled goods are for the customers account (unless goods have not been dispatched and we have delivered an item to you in error or an item that is damaged).

Errors

We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges or goods on the website, however in the event that The Scuba Pro Store advertises an incorrect price or any other reason (not due to our gross negligence), the company shall not be liable for any loss, claim or expense relating to a transaction based on any error. In the event of an incorrect purchase price, The Scuba Pro Store can cancel the order with reasonable notification, and customers will be entitled to receive a full refund withing seven (7) working days following notifcation.

Customer Privacy Policy

Scuba Equipment Africa shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment Options Accepted

Payment may be made via Visa or Master Card credit cards or by bank transfer into the Scuba Equipment Africa bank account, the details of which will be provided on request.

Credit Card Acquiring and Security

Credit card transactions will be acquired for Scuba Equipment Africa by Virtual Card Services (VCS) who are an approved payment gateway for First National Bank (FNB) of South Africa. ShopDirect uses SSL3 and credit card information is stored per Visa and Mastercard guidelines on the website. Users may go to www.comalytics.com to view their security certificate and security policy.

Customer Details Separate from Card Details

Customer details will be stored by Scuba Equipment Africa separately from card details which are entered by the client on the VCS secure site. For more details on VCS (Paygate) refer to www.vcs.co.za

Merchant Outlet Country and Transaction Currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).

Responsibility

Scuba Equipment Africa takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer services and support, dispute resolution and delivery of goods.

Country of Domicile

This website is governed by the laws of South Africa and Scuba Equipment Africa chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Unit B7, Northlands Deco Park, Newmarket Road, North Riding, Johannesburg, South Africa, 2169.

Variation

Scuba Equipment Africa may, in its sole discretion, change this agreement or any part thereof at any time without notice.
